Gooday bobullock.
                          I read it as a hobbyest will be exempt if he/she has 10000 litres or less & is not a commercial breeder/seller.(paragraph 4)

 Hobbyest will be exempt if he/she has 10000 litres or less. Plus, there is the provision of 'view to sale'

I have also added the other attachment from the DPI to the thread. The two documents should be read together.

HI all

Bit confused if my breeding tank is say 2000ltrs but my stocking tank is 12000ltrs do i require a permit Huh

Sorry all after reading further i understand now, but i am not totally agreeing with the new legislation ,Anyone who thinks they can make money out of this hobby without being a size able commercial premises must have rocks in there heads , i love these fish and will breed to further improve my stock quality without having any intentions of selling for profit , but to include even bartering or giving away surplus fish in the amendment as being a sale is a shame , To me it just means that 90% or more of my fry will have to be culled in order for me to just keep one or two quality fish Cry . And further i must ask whether the KSA was even consulted before the amendments were even made or a public proposal put forward?

I will be writing to DPI and also my local member and would suggest that more do the same.

Hi

I think you have missed the most important paragraph

"I assure you that a common sense approach will be taken by the departments compliance staff in implementation of the regulations amendments. This confirms the advice given to you by Mr Tim Gippel Senior Policy officer Aquaculture at your recent meeting in the Minister MacDonald's office. "

That means exactly what it says. Of course you can swap or sell at an auction a SMALL NUMBER of your Koi or to another Koi club member. They are not going to throw you into prison for that.

Its the people who breed ONLY for resale they want to make get a permit, and so they should.

The KSA sent in a detailed proposal and our submission. And the KSA was instrumental in getting this last agreement.


Please remember these laws were NOT made for KOI they were made for Aquaculture, Koi just come under the umbrella of Aquaculture.

As BB will testify, this is the best outcome we could have hoped for. The clubs can hold auctions, and as long as we are not breeding for profit, we can sell a few of our excess Koi at auctions and to other club members regardless of size ponds.

But we must all be mindful of the word "small "number and and show the fisheries respect as they have shown all Koi hobbyists.

thnx mary for the clarification , but i am still a little weary about the new regulation i believe that it brings them one step closer to doing the unthinkable , banning koi altogether at a later date  ( HOPEFULLY I AM WRONG )

Hi

I can assure you our NSW Fisheries have told us categorically, Koi will never be banned in NSW.

It would be physically impossible to ban Koi now. Tens of thousands of people keep Koi in Australia.

The common sense approach means just that. They will only target those who are obviously breeding for the purpose of sale.

The hobby keeper is safe from the regulations as their purpose is for improvement. They will not target the occassional sale. If they targetted the hobbiest who every once in a while, they would have to prosecute a thousand or more people.
